DMCA Summary: AgentMink respects intellectual property rights and complies with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512). As a stateless proxy gateway, inference traffic transits transiently in-flight through edge memory without being stored. This policy outlines the statutory requirements for filing a Notice of Claimed Infringement and Counter-Notification.

1. Overview & Digital Millennium Copyright Act (DMCA)

AgentMink (“AgentMink”, “we”, “us”, or “our”) respects the intellectual property rights of creators and expects users of our proxy gateway and developer platform to do the same. We comply with the provisions of the Digital Millennium Copyright Act (Title 17, United States Code, Section 512, “DMCA”) and will respond expeditiously to valid notices of claimed copyright infringement.

2. Role as a Transitory Edge Communications Conduit (17 U.S.C. § 512(a))

AgentMink functions primarily as a stateless proxy routing and cost arbitrage infrastructure gateway. In this capacity:

  • Transient Digital Conduit: Under 17 U.S.C. § 512(a), the gateway provides intermediate routing and transmission of data between customer applications and upstream artificial intelligence model endpoints.
  • No Permanent Storage: User prompts, inputs, and model completions stream transiently in volatile RAM within edge worker isolates and are not persistently stored, hosted, or made publicly accessible by AgentMink.

3. Procedure for Submitting a DMCA Notice of Infringement

If you are a copyright owner or an authorized representative and believe in good faith that content available on our marketing website (agentmink.com) or developer platform infringes upon your copyright, you may submit a formal written DMCA Notice to our Designated Copyright Agent.

To be legally effective under 17 U.S.C. § 512(c)(3), your notification must include all of the following:

  1. Physical or Electronic Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of the Copyrighted Work: Clear identification of the copyrighted work claimed to have been infringed (e.g., URL, copyright registration number, or description of the work).
  3. Identification of the Infringing Material: Specific identification of the material that is claimed to be infringing, including the exact URL or location on our website to enable us to locate the content.
  4. Contact Information: Information reasonably sufficient to permit us to contact you (full legal name, mailing address, telephone number, and email address).
  5. Good Faith Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. Statement Under Penalty of Perjury: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

4. Designated Copyright Agent Contact Information

Formal DMCA notifications and copyright inquiries should be directed to our Designated Agent:

  • Designated Agent: Copyright Compliance Officer
  • Email: dmca@agentmink.com
  • Secondary Legal Email: legal@agentmink.com
  • Corporate Entity: AgentMink Legal Department

5. Counter-Notification Procedure (17 U.S.C. § 512(g))

If material that you posted or configured on AgentMink has been removed or disabled as a result of a DMCA Notice, and you believe this was due to mistake or misidentification, you may submit a written Counter-Notification to our Designated Agent.

Pursuant to 17 U.S.C. § 512(g)(3), a valid Counter-Notification must contain:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or disabled and the location at which the material appeared before it was removed.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or Delaware if outside the United States), and that you will accept service of process from the complaining party.

Upon receipt of a valid Counter-Notification, we will provide the complaining party with a copy. Unless the copyright owner initiates a court action within ten (10) to fourteen (14) business days, the disabled material may be restored.

6. Repeat Infringer Policy (17 U.S.C. § 512(i))

In accordance with Section 512(i)(1)(A) of the DMCA, AgentMink maintains a strict policy regarding repeat infringers:

  • We reserve the right to suspend, disable API keys, or permanently terminate the accounts of users who are found to repeatedly infringe the intellectual property rights of others.
  • We will also terminate access for accounts that submit fraudulent, bad-faith, or knowingly misleading infringement notices.

7. Third-Party AI Model Generative Output Inquiries

Because AgentMink is an infrastructure routing proxy, inquiries regarding the training datasets or generative outputs of third-party foundation models (e.g., OpenAI, Anthropic, Google, DeepSeek, Mistral, Together AI, AWS Bedrock) must be directed to the respective upstream model creators who own, operate, and train those underlying models.
